General conditions of sale

1. Purpose and scope
These General Conditions of Sale (GTC) govern the sale of software licences ImagePipe
(extensions of optimization of images for WordPress/WooCommerce, PrestaShop and Magento shops) on the site imagepipe.devrunai.re. Any order implies full acceptance of these GTCs.
The site and the proposed licences are exclusively reserved for professionals acting in the course of their activity (businesses, independents, associations), excluding any sale to consumers within the meaning of the introductory article of the Consumer Code. The order requires the supply of a company name and SIRET number or intra-Community VAT; by informing them, the client declares and guarantees to act as a professional.

3. Products
ImagePipe is sold as a multi-tiered license (Lite, Pro, Ultimate, Business), described with their current price on the page Rates. Each tier defines a maximum number of sites on which the license can be activated simultaneously; the unlocked features are identical across all paid tiers.
4. Price and payment
Prices displayed are in euros. Payment is made at once, by credit card, via Stripe Checkout (secure payment provider). ImagePipe does not collect or store any credit card data.
5. Issue
The licence is issued immediately after confirmation of payment: a license key is issued and made available in the customer area (/portal), and a confirmation email is sent to the account address.
6. Right of withdrawal
Since these Terms of Reference are concluded exclusively with professionals (see Article 1), the right of withdrawal provided for in the Consumer Code does not apply. No contractual withdrawal right is granted: by validating the order, the customer agrees to request the immediate issuance of the licence upon confirmation of payment.
7. Duration, renewal and expiry
The Lite license (free) does not expire. The paid licences (Pro, Ultimate, Business) are valid for one year from the date of issue. To date, no online renewal mechanism is available: the customer must make a new purchase to extend their right of use.
8. Guarantee
Licences benefit from the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code) and the guarantee of hidden defects (articles 1641 et seq. of the Civil Code). In case of defects rendering the software unfit for use, contact rundevai@outlook.fr.
9. Intellectual property
The purchase of a license confers a personal and non-exclusive right to use the ImagePipe software, within the limits of the subscribed level. It does not confer any rights of ownership, redistribution, resale or retro-engineering of the source code. Any use outside the scope of the licence may result in its revocation.
10. Liability
ImagePipe is provided with an obligation of means. The seller cannot be held liable for indirect damages resulting from the use of the software (loss of data, loss of operation) or for service interruptions related to causes beyond its reasonable control (a failure of a third party provider, force majeure).
11. Personal data
The processing of personal data related to the order is described in the privacy policy.
12. Mediation
The mediation of consumption provided for in articles L611-1 et seq. of the Consumer Code is reserved for disputes between a professional and a consumer; Therefore, it does not apply to these GTCs, concluded exclusively with professionals (see Article 1). In the event of a dispute, the customer is invited to contact the seller (see Article 2) in order to seek an amicable resolution before any legal action.
13. Applicable law and disputes
These Terms and Conditions are subject to French law. In the absence of an amicable resolution, any dispute lies with the competent courts, in accordance with the rules of ordinary law.
14. Modification of these Terms and Conditions
These GTCs can be updated; the date at the top of the page reflects the last revision. The GTCs applicable to an order are those in force at the time of the order.
